BREAK INS


ONCE AGAIN THERE IS NEWS OF A BREAK IN TO A BARN IN OUR AREA. WE ARE SITUATED IN WAYNE COUNTY, ON THE NORTH SHORE BETWEEN PULASKI AND RUSSELL COUNTY. THE PROBLEM WITH THESE BREAK INS IS THE LACK OF POLICE CO-OPERATION. THE POINT THAT I FEAR THE MOST IS TO HEAR A CAR GO DOWN THE LANE AND TO CATCH SOMEONE IN THE ACT. AT THAT POINT IF I HAVE A FIREARM I BETTER BE READY TO USE IT. DOES ANYONE KNOW THE LAW AS IT PERTAINS TO THIS SITUATION? I WOULD HATE TO LOOSE EVERYTHING I HAVE WORKED FOR, JUST TO DO WHAT I AM SURE EVERYONE HERE AGREES IS THE RIGHT THING TO DO, SHOOT THE CROOK, AND HAVE TO FORFIET OUR NET WORTH TO THE PERSON WHO IS THE THIEF.
I AM AWARE OF A COMPANY CALLED X10 THAT SELLS SURVILIENCE EQUIPMENT THAT WILL TAPE TO A VCR ANY ACTIVITY NEAR OUR PLACE. I AM SERIOUSLY CONSIDERING SUCH A PURCHASE(AROUND $300.00)
IN CLOSING, THE LAST TIME WE HAD SUCH A BREAK IN THE POLICE GAVE ADVISE THAT WAS ILLEGAL. I KNOW HE WAS TRYING TO CONSOLE AND HELP, BUT I BELIEVE HIS FRUSTRATION WAS SHOWING. THANKS TO ALL

If you shoot him, you had better be dang sure that he is on your place and has a gun and even then, you are gonna probably have to set down a sack of cash to pay for your defense team. Amazing how that works aint it? I like the laws of old better...few of 'em and they only applied to the crooks. :o

That survilience equipment sounds like a good idea and a whole lot cheaper than a lawyer . We have had a lot of problems up here in ohio and I`m thinking about doing the same thing .

Make sure the thief is inside your domicile and had a weapon, thereby making it self defense. Shooting someone, or shooting at someone who is burglarizing an out-structure will get you arrested and charged.

Get the video survelliance equipment. At least you'll have a movie of your stuff being pilfered. The odds of getting any of it back are pretty slim. In a larger city, even slimmer. The local cops actually do make an effort, whereas I know the Lexington cops will privately advise you to find the person yourself and beat the snot out of them.

You can get a motion detector that turns on a bright light on/in your barn, AND will turn something on in your house at the same time, alerting you to the fact someone is in your barn. You can then call the police or handle it as you see fit.

I LIVE IN CINCY, AND AM AT THE MERCY OF THE THEIVES, WE HAVE PEOPLE WHO LIVE IN THE AREA AND PATROL AS BEST AS THEY CAN, BUT APPARENTLY THEY HAVE MISSED THESE THEIVES. THEY STOLE A JOHN DEERE GATOR EARLIER THIS WINTER, I BELIEVE THESE ARE "MATURE THEIVES" AND NOT CHILDREN OR KIDS.

You should invest in a security system that automatically calls the security company when activated. My boyfriend has one of these on his house, and they are great. If the alarm goes off, the company first calls whatever number you have supplied them with to make sure it isn't a false alarm. Then, they dispatch the cops, etc. In Cincy, the cops are there very quickly (don't know how it would work around the lake, but believe me, just the noise of the alarm would scare me off) I bet it can be heard from a quarter mile, especially if you put speakers outside. Also, you can have this hooked up to your fire alarms and everything, so that the fire dept. is dispatched in case of fire. YOu can even get cell phone backup, in case the thieves cut your phone lines. There is a monthly monitoring fee, etc, but if you say that you are concerned with losing everything you've worked for or your "net worth", or whatever, then it would be worth it.

I'm not a prosecutor however, as I am applying for my concealed carry permit 90% is understanding the law.
Kentucky and Ohio law do not protect you defending personal items. So when a person breaks in a attempts to walk off with your stuff and, you shoot the thief, weather they are in your house,garage, bedroom, etc. you have no defense and will be charged.

Shooting an individual is only considered last-resort should your life is in danger and all attempts to flee the scene have been exhausted.

So when you cap the ^$$$% who just stole your trolling motor, be prepared for a costly court date.

Forgive me, but "lack of Police cooperation." What do you mean??? How is it that you theorize that Police do not cooperate in these matters?

As for catching someone going down the lane…in the act my advice would be leave them alone and let the Police handle it. If you draw a gun on he/she, that is Wanton Endangerment, a felony.
If you detain them, and you cannot articulate that a crime was committed against you personally, you could face Unlawful Imprisonment charges, also a felony.

Finally, you imply that you would use deadly force in a situation such as the one you describe here. You have no legal right to injure, be it minor or fatal, someone in a situation like the one you are describing. (You are allowed to use deadly force only in very specific situations, and theft or burglary is not included on the list.) You must call the Police and let them handle it. Get as much information as you can, description of the person, car, clothing, direction of travel, etc.
Moreover, if you fail to restrain yourself and take the matter into your own hands, I can assure you will be arrested, charged, face a very expensive trial, and likely spend the next several years in prison.

Being calm and demonstrating maturity through self-restraint is the rule of thumb in these situations. Frustration and anger must never govern ones immediate actions.

I could really give a crap what the law says. Someone breaks into my house or I catch them stealing off my property I PROMISE you they will regret it. ;);) Omnia no offense dude but that sort of attitude from law enforcement, attorneys, and the courts is EXACTLY what is giving these criminals the balls that they have today. PERIOD. Same way with the kids. NO PUNISHMENTS or discipline for most kids nowadays and you see what it is getting us. A society ABSOLUTELY FULL of inconsiderate, rude, and unlawful children. Argue your points all your want till you are blue in the face. Look at the U.S. 50 years ago and compare it to today and tell me we are a country that is improving itself in any way other than technology. :(:(:(

In the old days a convicted horse theifs' near future was the gallows pole. Alot of the laws today protect the criminal from harm from the person they are stealing from. I pesonally don't understand this. BUT....its the law. UNLESS the criminal is trying to bodily harm you or your family. Then thats a different story.

In her best forrest gump voice....thats all I got to say about that.......

What I have seen on this thread is that you don't want to follow the law either. Taking a life is not only a crime in the eyes of the law, but I would worry more about what the real guy in charge might say. Bigragu...I'm locked and loaded AND proud of it! (hehe grinning at crownie)its a is a given here. The bible says: an eye for an eye, tooth for tooth, do unto others as they would do to you...... so read that like you may. I may read that different than others.

And I have the highest respect for law enforcement. But they can't be there all the time.

Hey ragu? What would YOU do if someone broke into your house there in Edgewood while your family was sleeping? Would you let them have their way with you and take your dignity and your possesions along with it? Would you immediately stop and consider what the higher power above would think? Or would you fight for your life and your familys life? I'm not trying to start anything with you, I really want to know what you would do in that situation. I assure you... theres no time to think about anything. You will do what you have to do to survive.


If you've never had to deal with theft, then you really don't know what you would do. When it happened to me...I went ballistic! I felt raped, very vilolated. And when I went to my house....I felt nasty. I had to clean everything. IE steamed cleaned all the carpets, washed walls, all the silverware, etc

Until you go through it....you have no clue how you would feel or what you would do.

I hope you NEVER experience it. I really do. Its the most god aweful thing........

Todays laws are for law enforcement officers and the criminal....period. I know that Omnia is pro law enforcement and I am too and the cops aren't to blame for these ignorant laws that we have. The officer just does the best they can with what they have to do with. The law makers are the ones who need the heavy dose of realization. 80% of the laws written in the past 25 years protect nobody. Not long ago the subject of receiving stolen goods was brought up and all of the LE folks on here said that it was easier to make and arrest for receiving stolen goods than to make one for stealing. Who does that protect? NOBODY but the thief and the LE officer. The thief will continue to steal and the cops get no heat for not making an arrest. :(
Also, Rod is 100% correct on what he says about today's kids.

Well, I have been a victim of a violent crime and one of my family members had as terrible an incident one could have. All I'm saying is that one can reason his way thru any circumstance to the correct outcome. I am also armed but I'm not giving up my life to any low life I happen to have to deal with. As far a victim of theft, been there done that, but you know what it's only stuff. It's not right to steal it's upsetting but it can be replaced. By the way the passage from the bible is not suppose to be interpeted that way. Don't get me wrong, even though I may not shoot you, YOU will always remember who I was. Is it spring yet???
